These Terms of Service ("Terms") govern your access to and use of the services, websites, and software provided by Zivv Tech LLC ("Zivv", "we", "us", or "our"), a limited liability company registered in the State of Wyoming, United States. By accessing or using our services, you agree to be bound by these Terms.
Zivv Tech LLC provides API management, intelligent request routing, cloud infrastructure, and related developer tooling on a subscription basis ("Services"). We may update, modify, or discontinue features of the Services at any time.
You must be at least 18 years old and capable of forming a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Services are offered under monthly subscription plans as described on our Pricing page. By subscribing, you authorize recurring charges until you cancel.
Payments are processed by our authorized reseller and Merchant of Record, Paddle.com Market Limited ("Paddle"). Paddle handles order processing, payment, invoicing, and the collection and remittance of applicable taxes. Your relationship for billing purposes is with Paddle, subject to Paddle's Buyer Terms.
You agree not to use the Services to:
All software, content, and materials provided through the Services are owned by Zivv Tech LLC or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
You may cancel your subscription at any time. Cancellation stops future renewals. Refunds are handled in accordance with our Refund Policy.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
To the maximum extent permitted by law, Zivv Tech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Services. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
We may suspend or terminate your access to the Services at any time for violation of these Terms or for any conduct that we reasonably believe may harm us or other users.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
We may revise these Terms from time to time. The updated version will be indicated by the "Last updated" date and is effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
